For over thirty years I've thought about the ninth amendment. I could never figure out what a retained right was until the Trayvon Martin case. Self defense is a retained right because it is not enumerated in the Constitution and it is considered to belong to each of us and can be used as an argument in court. Therefore laws that regulate self defense cannot be interpreted in such a way as to deny of disparage it. Since stand your groud laws are interpreted in such a way as to deny or disparage one's right to self defense they violate the ninth.
The gang injunction laws talked about yesterday, seemed to violate the retained right to participate in commerce. People are stopped on the street because they wear red. This may be constitutional, I don't know. What appears to be a violation of the ninth is the way the police interpret and administer the law. Instead of saying a person was stopped for wearing red and no unlawful behavior was observed or found on the person, they write the report in such a way as to give government cause to restrict, deny or disparage a person's right to participate in commerce as an equal.
Thanks for covering the spill. It's amazing how little coverage there is on the biggest environmental disaster in the country's history. On that note, how about giving Terra Verde a full hour once a week? I am a longtime KPFA member and I was always amazed how there is only a single half-hour per week devoted to the environment.
