Correction re: Medi-Cal Disability
Philip: I'm a big fan, KPFA Supporter. Since 1974 I have practiced SSI/Soc Sec Ins Dis law, and since 1990 I have helped uninsured Highland hospital patients get Medi-Cal Disability.
You stated on June 17 that an individual must be "certified" disabled by Social Security in order to be linked to Medi-Cal..This is partially correct, BUT
An individual can apply for and receive Medi-Cal disability linkage INDEPENDENTLY from Social Security Dis. Ins. or SSI. The confusion lies in the fact that when someone applies for Medi-Cal disability, Medi-Cal uses Soc. Sec./SSI disability standards. BUT the state of California ultimately applies the disability standards far more liberally than Social Security. ALSO
If an individual applies for BOTH Medi-Cal and Soc. Sec/SSI, once Soc. Sec makes a disability decision, that controls the Medi-Cal decision. There is an exception to that rule, too, but I don't want to bore you with lawyerly ponderings...
